Welcome to the Lovesac.com website! Accessing, browsing utilizing Lovesac.com (the "Site") or purchasing any product through the Site indicates your agreement to the Terms and Conditions contained in this agreement. If you do not agree with these Terms of and Conditions, do not use the Site.

Please read these Terms and Conditions carefully. These Terms and Conditions create a binding contract between you and Lovesac. By using the Site or purchasing products through the Site, you represent that you are of legal age in your jurisdiction of residency and have the capacity to be bound by these Terms and Conditions. BY AGREEING TO THESE TERMS AND CONDITIONS YOU ACKNOWLEDGE THAT: (1) THE TERMS AND CONDITIONS CONTAIN A BINDING ARBITRATION PROVISION, WHICH PROVIDES THAT THE PARTIES DESIRE TO RESOLVE ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS THROUGH ARBITRATION; and (2) BY AGREEING TO ARBITRATION, YOU ARE GIVING UP VARIOUS RIGHTS INCLUDING THE RIGHT TO TRIAL BY JURY AND TO BRING CLAIMS AS CLASS ACTIONS.

Lovesac reserves the right to change and update this website (Lovesac.com) and the Terms and Conditions contained herein at any time without written notice.

Shipping

We offer 100% free shipping on all orders within the contiguous United States. Orders typically deliver in approximately 1-4 weeks (some restrictions may apply). Custom covers typically take between 4-10 weeks for delivery.  No time frame is guaranteed.  Sacs, Sactionals pieces and covers may be fulfilled and shipped from different warehouses and may be received at different times. Due to the restrictions of our shipping partners, we are unable to deliver to P.O. boxes / APO or FPO addresses.

Please note that our products may arrive in multiple boxes or packages on multiple dates. Customers should anticipate at least one box per Seat or Side purchased. Reclining seats ship in two boxes weighing between 100-105 pounds and require two people to lift.

Shipping is only available within the United States.

Risk of loss and title for all Lovesac products pass to you upon our delivery to the carrier.

Pricing

With respect to items sold by www.lovesac.com, we cannot confirm the price of an item until you order. Payments are charged at the time you place your order. Prices are provided in United States Dollars.

Lovesac’s non-discounted prices as shown on the Site are based on our subjective opinion of the value of our product, taking into account cost, quality, profit margin, offered warranty, competition, and shipping and freight costs. Sactionals Seats and Sides and Covers are sold separately.  Non-discounted prices for Sactional configurations are based on the price of each component (Seat, Side, Covers, Accessories) when offered for sale individually.  Once individual components are bundled, certain applicable discounts may be applied and displayed as the price of your selected Sactional configuration. Non-discounted prices for Sacs (Inserts and Covers), StealthTech and Accessories are Lovesac’s offer price. This means that Lovesac has recently offered the product at the non-discounted price, but may not have sold the product at the non-discounted price in the recent past.

Returns & 60-Day Home Trial

Your 60-Day Home Trial will begin once all items in a single order from our Sactionals or our Sacs brands have been delivered, exclusive of accessories (see Accessory Warranty page for details). For Sactionals, this includes your Seat and Side Inserts, Covers, and any StealthTech Sound + Charge Items. For Sacs, this includes Sac Inserts, Squattomans, and Covers.  Eligible merchandise may be returned within 60 days from the date you received it for a full refund or exchange. Custom merchandise, floor model, and clearance item sales are final, and returns cannot be issued. Any shipping and/or delivery fees are non-refundable. Gift Card purchases cannot be cancelled or returned.

All returns must be sent via scheduled FedEx pick-up or an approved third-party, if necessary. Returns should be packaged in the original packaging. If the original packaging is no longer available, Lovesac may be able to provide upon request, based on availability. Lovesac does not provide boxes for Covers or Accessories.

Refunds will only be processed once all items in the return have been received and verified by Lovesac. Once verified, you will be issued a refund back to the original form of payment.  If you paid in a Showroom with cash, refunds will be issued with a corporate check sent to the shipping address on file and may take an extended period of time.

Merchandise is eligible for a one-time price adjustment within 7 days of the date ordered. Floor models and clearance merchandise are not eligible for price adjustment. Financing terms cannot be adjusted after a purchase is made. Proof of purchase is required for all returns, exchanges, warranties, and refunds.

Warranties

Lovesac’s products are built to last and designed to evolve with you.  Each Lovesac product has its own warranty timeframe and terms specific to the product’s features.  Lovesac’s warranty only covers products purchased by the customer directly from Lovesac that have been used in an indoor, residential setting, (excluding Outdoor Sactionals). The applicable warranty time frame for each product begins on the order date. Lifetime warranties apply to the original purchaser with a maximum of 100 years from the order date.  Warranties for each Lovesac product may be found here.

During the applicable warranty period and subject to these terms and conditions, Lovesac will replace an eligible product impacted by a manufacturer defect with the same or similar product as originally purchased by the customer.  Warranty applies to impacted product only. Customer shall not be entitled to a replacement or store credit for other products not impacted by a manufacturer defect that are contained in the same order as an impacted product.

Gift Cards

Gift Cards are redeemable for merchandise only and are not redeemable for cash, except as required by law. Individual Gift Cards cannot exceed a value of Two Thousand Dollars ($2,000). Lovesac does not accept responsibility for cards lost, damaged or stolen, or any unauthorized use of cards and unauthorized resale is prohibited.

Typographical Errors

In the rare occurrence an item is listed with an incorrect price, discount or description due to a typographical error or erroneous information received from our suppliers, Lovesac reserves the right to refuse or cancel any orders placed for the product listed at the incorrect price, regardless of whether you have received an order confirmation or your credit card has been charged. If your credit card has been charged for a purchase and the order is cancelled, Lovesac shall immediately issue a credit to the same card for the same amount of the charge.

Product Descriptions

Lovesac and its affiliates attempt to be as accurate as possible. However, Lovesac does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current or error-free. Wood products may contain variations in grain and color from the picture shown on the Site.

Electronic Communications

When you visit www.lovesac.com or send emails to us, you consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You have the right, at any time, to opt out or unsubscribe to future electronic communication from Lovesac, however you cannot opt out of receiving emails that pertain to any orders you have placed.

California Ethical Supply Chain Statement

At Lovesac, ethics, transparency, and compliance are top of mind.  Our vendor compliance policy as outlined in Lovesac’s Vendor Manual, includes regular on-site auditing and corrective measures for noncompliance. Lovesac has a zero-tolerance policy for any evidence of bribery and corruption, forced labor, human trafficking, and child labor. These practices are unacceptable in our supply chain. Lovesac will not accept products or services from vendors that use forced or child labor. Vendors are expected to comply with applicable local child labor laws and employ workers who meet the minimum legal age requirements. Applicable Law

By visiting www.lovesac.com, or purchasing any products from Lovesac, you agree that the laws of the state of Connecticut, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and Lovesac or its affiliates.

Disputes and Waiver of Certain Rights

PLEASE REVIEW THIS SECTION CAREFULLY – THIS SECTION LIMITS YOUR RIGHTS INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION AND THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE ACTION.

Any dispute relating in any way to your visit to www.lovesac.com or to products you purchase through www.lovesac.com shall be submitted to confidential arbitration in Stamford, Connecticut  except that, to the extent you have in any manner violated or threatened to violate Lovesac’s intellectual property rights, Lovesac may seek injunctive or other appropriate relief in any state or federal court in the state of Connecticut, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

To the fullest extent permitted by applicable law, no arbitration or other claim under this Agreement shall be joined to an arbitration involving any other party, whether through class arbitration proceedings or otherwise. All claims must be brought in a party’s individual capacity and not on a class or representative basis. You waive the right to participate in any form of class, or act as a class representative or private attorney general.
