Lovesac Terms and Conditions apply to all purchases and site use. By buying or using Lovesac, you agree to settle disputes by arbitration, not trial. Shipping is 100% free in the US, but arrival dates are not guaranteed. Products may come in multiple boxes. You can return eligible products for a full refund or exchange within 60 days. All warranties are for indoor use and often last a lifetime. Prices can change without notice. Lovesac keeps your emails for order updates. Gift Cards are capped at $2,000 and are for products only, not cash. Misuse or breach cancels your account.

Accessing, browsing utilizing Lovesac.com (the "Site") or purchasing any product through the Site indicates your agreement to the Terms and Conditions contained in this agreement. If you do not agree with these Terms of and Conditions, do not use the Site. These Terms and Conditions apply to all quotes, invoices or purchases made in our showrooms.

Please take a moment to read these Terms and Conditions. When you use our site or buy products here, you agree to a contract with Lovesac. You confirm you are old enough in your area and able to agree to these Terms. When you accept, you should know two important things: First, these Terms ask that if any problems or disagreements come up, we settle them through arbitration instead of going to court. Second, by choosing arbitration, you give up some rights, like having a jury trial or starting a class action. We want you to feel comfortable and informed, so please reach out if you have questions. Thank you for being part of the Lovesac family—where comfort you can feel is always 'Designed for Life.'

Lovesac reserves the right to change and update this website (Lovesac.com) and the Terms and Conditions contained herein at any time without written notice.

Shipping

We offer 100% free shipping on all orders within the contiguous United States. Orders typically deliver in approximately 1-4 weeks (some restrictions may apply). Custom covers typically take between 4-10 weeks for delivery.  No time frame is guaranteed.  Sacs, Sactionals pieces and covers may be fulfilled and shipped from different warehouses and may be received at different times. Due to the restrictions of our shipping partners, we are unable to deliver to P.O. boxes / APO or FPO addresses.

Please note that our products may arrive in multiple boxes or packages on multiple dates. Customers should anticipate at least one box per Seat or Side purchased. Reclining seats ship in two boxes weighing between 100-105 pounds and require two people to lift.

Shipping is only available within the United States.

Purchase Terms

• Prices are subject to change without notice and are at the discretion of Lovesac.
• All prices are final upon purchase.
• Current promotional offerings cannot be applied to the purchase of Gift Cards.
• A 100% deposit is required for every order placed on Lovesac.com.
• You must agree with all of these terms and conditions for us to process your order.
• The receipt of an order number or an email order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Lovesac reserves the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any customer. Verification of information may be required prior to the acceptance of an order. However, by confirming your purchase at the end of the checkout process, you agree to accept and pay for the products, and applicable taxes. Lovesac reserves the right, at its sole discretion, to refuse or cancel any order for any reason.

Risk of Loss

Risk of loss and title for all Lovesac products pass to you upon our delivery to the carrier.

Pricing

With respect to items sold by www.lovesac.com, we cannot confirm the price of an item until you order. Payments are charged at the time you place your order. Prices are provided in United States Dollars.

At Lovesac, our regular prices shown on the Site reflect how we value each product—considering cost, quality, comfort you can feel, offered warranty, competition and shipping. Sactionals Seats, Sides, and Covers are available separately, letting you create your own style for limitless configurations. When you build a Sactional setup, the price is based on the total of each Seat, Side, Cover, and Accessory, just as if you bought them on their own. Once you bundle pieces, discounts may apply and show up as the price for your chosen Sactional. For Sacs (Inserts and Covers), StealthTech and Accessories, our regular price is the offer price—meaning we’ve recently offered it at that amount, though it might not have sold at that price recently.

Returns & 60-Day Home Trial

Your 60-Day Home Trial will begin once all items in a single order from our Sactionals or our Sacs brands have been delivered, exclusive of accessories (see Accessory Warranty page for details). For Sactionals, this includes your Seat and Side Inserts, Covers, and any StealthTech Sound + Charge Items. For Sacs, this includes Sac Inserts, Squattomans, and Covers.  Eligible merchandise may be returned within 60 days from the date you received it for a full refund or exchange. Custom merchandise, floor model, and clearance item sales are final, and returns cannot be issued. Any shipping and/or delivery fees are non-refundable. Gift Card purchases cannot be cancelled or returned.

All returns must be sent via scheduled FedEx pick-up or an approved third-party, if necessary. Returns should be packaged in the original packaging. If the original packaging is no longer available, Lovesac may be able to provide upon request, based on availability. Lovesac does not provide boxes for Covers or Accessories.

Refunds will only be processed once all items in the return have been received and verified by Lovesac. Once verified, you will be issued a refund back to the original form of payment.  If you paid in a Showroom with cash, refunds will be issued with a corporate check sent to the shipping address on file and may take an extended period of time.

Merchandise is eligible for a one-time price adjustment within 7 days of the date ordered. Floor models and clearance merchandise are not eligible for price adjustment. Financing terms cannot be adjusted after a purchase is made. Proof of purchase is required for all returns, exchanges, warranties, and refunds.

Warranties

Lovesac’s products are built to last and designed to evolve with you.  Each Lovesac product has its own warranty timeframe and terms specific to the product’s features.  Lovesac’s warranty only covers products purchased by the customer directly from Lovesac that have been used in an indoor, residential setting, (excluding Outdoor Sactionals). The applicable warranty time frame for each product begins on the order date. Lifetime warranties apply to the original purchaser with a maximum of 100 years from the order date.  Warranties for each Lovesac product may be found here.

Exclusions:

Lovesac’s warranty does not apply to the following:

• Product failures or issues stemming from normal use, abuse or wear, including failure to follow washing, care, assembly or use instructions.
• Products used for commercial purposes.
• Products sold as Floor Models.  All Floor Models are sold in “as is” condition and are not covered under warranty.​

Warranty Claims:

To submit a warranty claim, a customer must submit:

• The original receipt or original order number showing a purchase by the individual requesting the warranty claim is required;
• Photographs showing the defects and failures with the product; and
• All other information requested by Lovesac on the warranty claim form found here.

If your product has a problem caused during manufacturing, and the warranty is still valid, Lovesac will replace it with the same or a similar product. This is subject to these terms and conditions. The warranty only covers the affected product. If other products in your order are not affected by a manufacturing problem, you cannot get a replacement or store credit for those items.

Gift Cards

Gift Cards are redeemable for merchandise only and are not redeemable for cash, except as required by law. Individual Gift Cards cannot exceed a value of Two Thousand Dollars ($2,000). Lovesac does not accept responsibility for cards lost, damaged or stolen, or any unauthorized use of cards and unauthorized resale is prohibited.

Typographical Errors

If an item is listed with the wrong price, discount, or description because of a printing mistake or incorrect information from our suppliers, Lovesac may refuse or cancel any orders for that product. This applies even if you have already received an order confirmation or your credit card has been charged. If your credit card was charged and your order is cancelled, Lovesac will quickly issue a refund to your card for the same amount.

Product Descriptions

Lovesac and its affiliates attempt to be as accurate as possible. However, Lovesac does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current or error-free. Wood products may contain variations in grain and color from the picture shown on the Site.

Electronic Communications

When you visit www.lovesac.com or send emails to us, you consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You have the right, at any time, to opt out or unsubscribe to future electronic communication from Lovesac, however you cannot opt out of receiving emails that pertain to any orders you have placed.

All content on this site—including graphics, logos, button icons, images, audio clips, digital downloads, data, and software—is owned by Lovesac, its affiliates, partners, or suppliers. You may post reviews, comments, and other content. You can also send e-cards and other messages. Suggestions, ideas, questions, and other information are welcome, as long as your content follows these rules: - Do not post false, inaccurate, or misleading content. - Do not post anything illegal, obscene, threatening, defamatory, or invasive of privacy. - Do not post material that infringes intellectual property rights or is harmful to others. - Your content must not include software viruses, political campaigning, commercial offers, chain letters, mass mailings, or any type of spam. When you post, do not use a fake email address, pretend to be someone else, or mislead about where your content or e-card came from. At Lovesac, ethics, transparency, and compliance are top of mind.  Our vendor compliance policy as outlined in Lovesac’s Vendor Manual, includes regular on-site auditing and corrective measures for noncompliance. Lovesac has a zero-tolerance policy for any evidence of bribery and corruption, forced labor, human trafficking, and child labor. These practices are unacceptable in our supply chain. Lovesac will not accept products or services from vendors that use forced or child labor. Vendors are expected to comply with applicable local child labor laws and employ workers who meet the minimum legal age requirements. Applicable Law

Disputes and Waiver of Certain Rights

PLEASE REVIEW THIS SECTION CAREFULLY – THIS SECTION LIMITS YOUR RIGHTS INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION AND THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE ACTION.

Any dispute relating to your visit to www.lovesac.com or to products purchased through www.lovesac.com or our showrooms must go to confidential arbitration in Stamford, Connecticut. However, if you violate or threaten to violate Lovesac’s intellectual property rights, Lovesac can seek an injunction or other relief in Connecticut state or federal courts. You agree to the exclusive jurisdiction and location of these courts. Arbitration will follow the current rules of the American Arbitration Association. The arbitrator’s decision is final and can be enforced in any competent court.

To the fullest extent permitted by applicable law, no arbitration or other claim under this Agreement shall be joined to an arbitration involving any other party, whether through class arbitration proceedings or otherwise. All claims must be brought in a party’s individual capacity and not on a class or representative basis. You waive the right to participate in any form of class, or act as a class representative or private attorney general.
